Active Travel Logger Website and Smarter Travel Step Counter
This Privacy Notice is issued by the National Transport Authority ofDún Scéine, Harcourt Lane, Dublin 8 (" NTA", " we", " us", " our"). It provides an overview of the data relating to you that we may collect and use in connection with the Active Travel Logger and Smarter Travel Step Counter, how we will use it and how you can exercise your rights in relation to your data. What personal data do we collect?
The personal data we may collect includes:
- your name and contact details
- your photograph if provided
- your organisation i.e. workplace or college
- the username and password to your account on the Active Travel Logger Website
- any additional information you provide us
How is your personal data used?
The main purposes for which we use your personal data are to:
- register and manage your account on the Active Travel Logger Website and provide you with support
- allow you to use the Smarter Travel Step Counter to count/sync steps
- inclusion in run competitions and promotions and Smarter Travel Challenges
- send you updates and carry out research and customer satisfaction surveys
- uploading photographs to social media, websites, ezines and reports in relation to Smarter Travel Challenges, promotions and competitions
- send you promotional and marketing materials, subject to any preferences that you express
- generate and analyse statistics regarding usage of the Active Travel Logger Website
- perform our functions as a public authority and comply with our legal obligations.
The main legal bases on which we process your personal data are that this is necessary for the performance of tasks carried out in the public interest or for the performance of our contract with you, to comply with our legal obligations or that you have given your consent.
Sharing of personal data
We may share your personal data with other organisations including:
- third party service providers in connection with the Active Travel Logger Website and the Smarter Travel Step Counter, such as outsourced service providers, IT services providers, professional advisers and auditors
- ther public authorities and bodies where required or permitted by law, such as the Gardaí for the purposes of the prevention, investigation or detection of crime.
Your Rights
You have the rights, subject to certain restrictions, to:

Access
Access to and use of the National Transport Authority’s (the "Authority") website at ActiveTravelLogger.ie is governed by these Terms and Conditions.
These Terms and Conditions set out the basis upon which you are entitled to use the National Transport Authority’s website at ActiveTravelLogger.ie.
The Authority reserves the right to change these Terms and Conditions at any time by posting changes online without prior notification.
You are responsible for regularly reviewing information posted online to obtain timely notice of such changes as the updated Terms and Conditions will apply to your subsequent uses of the Active Travel Logger website.

You shall not (by using any device, software or routine) interfere with or attempt to interfere with the efficient operation of this site. This includes (but is not limited to) by act or omission, imposing an unreasonably or disproportionately large or heavy workload on the technical infrastructure of the site (by mass e-mailing, or otherwise).
Prizes and Competitions
Details of prizes for Smarter Travel Challenges will be announced on the relevant competition pages on the Smarter Travel Workplaces website.
Individual challenges may comprise a mix of internal-Partner prizes and Authority-awarded prizes.
The provision of internal-Partner prizes is a matter for the individual Partner organisation.
For Authority prizes, how prizes are awarded will be clearly stated for each competition e.g. prize draw, merit-related etc. Details of prize winners (name, team, organisation) will be published in media/ arenas including but not limited to – the Authority's websites, social media accounts, Partner emails/ ezines, Partner seminars. For competitions relating to stories/ photos or other material provided by participants, the winning entries will be published by the Authority as above.
Details of prize winners or winning photos/ stories may be withheld at the request of the winner – Please contact the Smarter Travel Workplaces directly to do this. Please note that for auditing purposes, a level of detail will need to be published.
The awarding of Authority prizes is subject to the decision of the Authority, and the Authority reserves the right to award all or none of the prizes stated. The decision of the Authority is final.
Winners may also be asked to participate in a publicity shoot. By participating in a shoot, participants agree that their image may be used by the Authority for publicity and materials.
To be eligible for Authority Prizes, winners must be resident in the Republic of Ireland and be employees or students of Smarter Travel Workplaces or Smarter Travel Campus Partner.
In the event of any dispute regarding the rules, conduct, results and all other matters relating to Smarter Travel Programme Competitions or Challenges, the decision of the Authority shall be final and no correspondence or discussion shall be entered into.

Calculations
Leaderboard scores reflect the average steps/trips logged by a team. For walking challenges, desk-based teams are those who are generally based at a desk during working hours.
Teams which do not have the required minimum on a team and teams that have outstanding inquiries about their activities will be marked TBC on Leaderboards.

As part of our work with employers and third level institutions to implement voluntary travel plans and promote public awareness of alternative means of transport, we provide fun and free walking, cycling and public transport challenges ("Smarter Travel Challenges") through our website, ActiveTravelLogger.ie (the "Active Travel Logger Website").
The purpose of this notice is to inform you of the data relating to you that we collect and use in connection with the Active Travel Logger Website and the uses (including disclosures to third parties) we make of such data. The NTA is not responsible for the content or privacy practices of any linked sites.

Personal Data that we Collect and Process
We will collect and process personal data relating to you in connection with your use of the Active Travel Logger Website and our relationship with you. This personal data may include:

Technical details in connection with visits to the Active Travel Logger Website are logged by our internet service provider. When you visit the Active Travel Logger Website, the following information is retained about that visit:

generating reports and analysing statistics regarding participation in Smarter Travel Challenges (where possible, personal data will be anonymised before being used for this purpose);
generating and analysing statistics regarding usage of the Active Travel Logger Website, including the frequency of use of individual pages (where possible, personal data will be anonymised before being used for this purpose);
fraud prevention, investigation and detection;
establishing, exercising or defending legal claims;
performing our functions as a public authority and complying with our legal obligations.
The legal bases on which we process your personal data are:
that this is necessary for the performance of our contract with you governing your use of the Active Travel Logger Website;
that this is necessary for the performance of tasks that we carry out in the public interest or in the exercise of official authority vested in us by law;
that this is necessary for compliance with a legal obligation that applies to us; or
in the circumstances where you have given consent to the processing
Recipients of Data
We may disclose your personal data to other organisations in connection with the above purposes, including:
to third parties who we engage to provide services to us in connection with the Active Travel Logger Website such as outsourced service providers, IT service providers, professional advisers and auditors;
to other public authorities and bodies where required or permitted by law, such as the Gardaí or other law enforcement authorities for the purposes of the prevention, investigation or detection of crime.
Retention
We will not hold your personal data for longer than is necessary. The data retention policy of the Smarter Travel Workplaces and Smarter Travel Campus programmes for personal data is 24 months. We will keep your personal data on file for 24 months from your last activity, after which time, your data will be securely deleted.
Transfers Abroad
In connection with the above we might transfer your personal data outside the European Economic Area, including to a jurisdiction which is not recognised by the European Commission as providing for an equivalent level of protection for personal data as is provided for in the European Union. If and to the extent that we do so, we will ensure that appropriate measures are in place to comply with our obligations under applicable law governing such transfers. These may include entering into a contract governing the transfer that contains the 'standard contractual clauses' approved for this purpose by the European Commission. Requirement to Provide Data
You are not obliged to provide us with any personal data except where you decide to create a user account and we need it for this purpose. If you do not provide us with the information required to create an account, we will not be able to create one for you.
